For the life of me I can’t figure out how a state DA can charge anybody with a crime covered by federal law? How does a misdemeanor get elevated to a felony? How do they get around the statute of limitations? I don’t think there will be an arrest, it’s political theatre.

You are correct, the only way it is not a misdemeanor would be if it was used to cover up a felony.
