How do you handle trespassers

Did the purple paint law pass recently?

I haven't heard anything about it here. It would make posting much easier. And cheaper.


Regarding statutes, I'm not a lawyer so this isn't legal advice -
You are technically trespassing in the 3rd degree on land that's not posted. Whether the police and prosecutor in your area will proceed with charges in that case is another question. They usually require one warning to be given, verbal or written. Lots of other factors play in - what were they doing there, what was their intent, was it at night, were they armed or have "burglary tools", is it in the middle of nowhere with no fences or signs, or is a residence nearby, etc, etc.

2nd degree criminal trespass is generally used after a warning has been given. This CAN include posted signage, but again, the police and prosecutor will make that decision.

1st degree is for trespass inside a building.

The key point here is it's best if you have property posted, and you're much better off especially if you DOCUMENT the trespass warnings that you give out.

Trespassing and Hunting with out permission are two different charges in Indiana. With two different requirements to press charges. Wandering around unarmed looking for the Frosty Top, requires a request to leave to be charged.

Carrying a weapon and trespass with out permission does NOT. When you decide to go hunting, YOU are responsible for knowing where you are allowed to hunt and have the common sense to stay there.

How do you people find your way to work and back on your own, the rest of the year? Do people just meet you at their property lines and point you toward where you are suppose to go or are YOU responsible for choosing left or right, North, South at the intersection for your self? Just like you were grown up adults?

I said when i bought my farm in SC ,two years ago , i would prosecute the hell out of anyone i caught trespassing. Caught the first guy this year in a tree with a damn posted sign on it! I got him down from the tree and talked to him. I actually believed his story about being misinformed by the neighbor that gave him permission. Got his name and sent him packing. I was mad as fk and i think he caught the drift.

While we are on the subject, does anyone know who the guys are that trespass on Green River WMA during gun season? The archery only section. Someone is bound to know some of them, must be at least 50-60 a season that do it.

I don't know about Green River, but I can tell you the same thing was common on Ky River WMA before they started the quoted hunts. I bow hunted there during gun season thinking I'd have it to myself and encountered gun hunters daily.......with and without orange !!

I use to get pretty mouthy with trespassers. From now on, I'll just let the Trooper handle them. Got a feeling that having a Trooper for a son will be a great deterrent to trespassing.
