My daughters boyfriend and his brother were out hunting this evening. They are telling me that the dogs jumped a rabbit close to the property boundary and that it headed towards the neighbors house. The neighbor was either already on the back porch or came out immediately and killed their dog. Is there any actions can be taken? Or is it just a case of tough shit for them? I honestly don’t know.

You can kill a dog harassing livestock, poultry, humans, etc. - not just for being on a property.

Under Section 258.235, any person may kill or seize any dog which he sees in the act of pursuing or wounding any livestock, or wounding or killing poultry, or attacking human beings, whether or not such dog bears the license tag required by the provisions of this chapter. There shall be no liability on such person in damages or otherwise for killing, injuring from an attempt to kill, or for seizing the dog. That same section also comprises the state's new strict liability law for dog bites. Under Sec. 235(4), any owner whose dog is found to have caused damage to a person, livestock, or other property shall be responsible for that damage.

Just got a more detailed account and update. The landowner came out and yelled at them to get their dogs off his property. They crossed the property boundary to retrieve them. As they were walking to get them the landowners wife came out and shot the dogs. One is dead and they just discovered the other is bleeding in a few places so they are taking it to the vet. State Police has been contacted. They called and said they are going to investigate it.
