Turk-- These easement options can be hunted if allowed for. It's something the LKS is looking into now as an option. We have a Committee formed to study the ins and outs of it. Stay tuned.

Its still private land (so to speak). Permission from the land owner would have to be obtained for you to hunt it. The only difference is that private citizens can't develop it but the Gov. can build a freeway on it if they need one [;)]

True...but the right to hunt it could be locked in on the contract in exchange for the tax relief. IT would still be up to the property owner, more or less, unless spelled out differently in the contract. An example would be the private owned lands we are now hunting as WMA's could be done this way?
And it might not keep the Gov. from building a freeway, because that gets into emineint domain issues. It does keep the land from commercial development and houses being built on it.
Anyway, it's early on in the process. The Nature Consrvancy is doing this and it's something to look into as a possible solution.

I have an application pending on a farm for the PACE program. The only rights the landowner gives up are development rights. Other than that the owner still has the right to farm, graze, hunt ect. It changes nothing as far as hunting or tresspassing rights. It's a great program to preserve farmland.
This article mentions that the state currently has no funding for the PACE program. It dosen't mention that Kentucky lost millions of dollars in matching federal funds the last time it failed to pass a budget with funds for this program included.[:(!]

Conservation easements are excellant means to preserve ground for the future, but be careful. There are organizations out there that do require no hunting as a part of their terms. Unfortunately, I can't remember off hand who they are.
Certain organizations, such as the NWTF, DU and the RMEF are actively pursuing easements. Generally, they require some degree of habitat improvement and maintenance, and require the ground continue to be used for hunting.
An easement is a binding restriction on your title, and it will restrict you, your heirs and anybody else who takes the title down the road. Don't ever sign one until you have had it reviewed by a good real estate lawyer who has explained to you exactly what the effect of the deal will be. I have seen numerous forms of these, and some of them have some big time "gotchyas".
And a CE won't stop a highway for ten seconds. Condemnation trumps.

The Nature Conservancy doesn't permit hunting or access to the average tax payer on property that they control.[V] Access for"educational purposes" as determined by <u>The Nature Conservancy</u>. Property purchased or easements arrannged by this group are <u>closed to the Kentucky sportsmen for ever more</u>.[:(!]
Has The Wild Turkey Federation ever purchased any property or easement on property in Kentucky that is open for public hunting??[?]
