If this is indeed the circumstances its pretty cold hearted and likely to get someone in trouble because its illegal for the reason stated in the article..I personally saw the state lose a case just like this one..

On the face of it, it is coldhearted. But the article doesn't say if she relied on just sick days or used FMLA. For whatever reason, we have people here to refuse to use FMLA and get into attendance problems when if they had used FMLA, they would have been protected.
Then from the business point of view, if it takes 10 people to run the business, but if you could never count on one to show up, what do you do? Sure, you could argue that because her son had cancer, she should be given special benefits, but what do you say to the next guy who wants the same benefits because he has no children, but his dog has cancer? Or the guy after that who says he's just tired? Where do you draw the line?

you still only have so many fmla days a year. I think it is 120 days. We had someone at work that had a very sick child that was dieing and ran out of fmla days.
