I found this while looking for the paddlefish deal---As a property owner, I don't agree that I should need signs up before someones is required to ask for permission to tresspass.

HB 671 (BR 2332) - J. Gray

AN ACT relating to hunting and fishing regulation.

Amend KRS 150.170 and 150.190 to exempt resident or nonresident observers and participants in field trials, competitions, and training from licensing requirements as approved by the Department of Fish and Wildlife if no game is taken; amend KRS 150.092 to exempt observers and participants in field trials, competitions, and training from needing the active consent of property owners to enter private property if there are no signs posted to prohibit trespassing and or hunting, or if the property owner does not notify the Department of Fish and Wildlife or the group conducting the event that he or she will not allow trespassing.

HB 671 - AMENDMENTS

HCS - Retain original provisions of bill, except delete Section 3, relating to exempting field trials, competitions, and training exercises from needing the consent of property owners to enter private property.

I agree with you Multi. Does that I mean I need a sign at every window and door of my house too? My Jeep sits in my driveway right now with the windows down- is it mine or is it community property? What about those nice horse farms of the Bluegrass? They don't have a sign on every plank- looks like a fun place to play touch football, fly kites and have a picnic.

Did ANYONE know about this? Where are our Politicians who look out for us?

I don't care WHO they are or what they're doing.....If they're on our land without permission, they're going to get "escorted" off, even at gun-point if necessary (or at least that's the rumor about me on the "creek"). I've done it before, I'll do it again!

I can put thousands of signs up, but someone manages to tear them down or steal them. I give up!!!!!!!!!! Is anybody on the landowners side?

I ain't no lawyer or judge, but I think the intent here is you can go get your dog on someones property.
I know it sounds like a group of people can walk in and have a field trial on your land. From where I am from, if you tried that on some farms, the judge may only hear one side of the case.<img src=icon_smile_wink.gif border=0 align=middle>

I followed coon dogs for years, and rabbit dogs for quiet a long time--A dog can't read a sign for sure. BUT that thing said that participants AND observers could cross. That's against the intent of just retrieving your dog.

Marcus--it's a lot more trouble but at the Club we post the signs up high--carry around a few sections of a light weight ladder stand and put them out of reach. they will last longer, but not for ever even at that.

THe ammendment to the bill removes the private land exemption. On the other hand, I've never seen such a blatant, communist-dictator-type disregard for the property rights of landowners. These damn liberals believe the government owns all the land and we are just po' sharecroppers!! Throw the bums out!!! Anyone who doesn't know any more about Constitutional Law than that should not be a legislator!!

Multi I have no idea where that stuff came from, but you will be glad to hear that it is not accurate. I would like to know where it did come from so I can look into it further. Here is what all that says in my book.

KRS 150.092(1) Persons shall not enter upon the lands of another to shoot,hunt,trap or fish, or for any other wildlife-related recreational purpose, without the oral or written permission of the landowner, tenant, or or person who has the authority to grant permission,

(4) Persons who who enter upon the lands of another to shoot, hunt, trap, or fish, or for any other wildlife-related recreational purpose, shall not, through their actions, cause damage to any buildings, fences, crops, livestock or domestic animals, mmachinery, or any other property while on these lands.

KRS 150.170(4) Residents and Non-Residents observing and partipating in any field trial as authorized by the Dept. may observe and participate without obtaining a hunting license so long as game is not taken.
It makes no mention anywhere in KRS150.170 of have signs posted or contacting KDFWR about not allowing tresspasing.

KRS 150.190 talks about the requirements of a getting a commercial guide license.

Only thing I can figure is that was an old law or maybe never was one. Maybe it was a law someone try to get passed and it never made it. I hope that clears it up a little. I'll try to answer any questions yall got on it.

Unit, from the text it appears to have been signed by the governor on April 2 of this year and probably hasn't found it's way into your manual yet. The language about entering the lands of others was removed while the bill was in conference. That part did not pass. Only the part about licenses.

Didn't know all that was going on. I was in school when that was getting passed. Glad to see Section 3 did not make it.
