I agree what he did was wrong but do scrapes and bruises and the fact that a 62 year old is "getting killed" on NASCAR web site blogs need to be hashed out in court for damages?

A Miami law firm announced its plans Monday to file a lawsuit against a NASCAR driver accused of assaulting a 62-year-old security guard at the Homestead-Miami Speedway last month. Russell Dohan, an attorney with Goldberg & Dohan, said the lawsuit against NASCAR driver Kasey Kahne would be filed Monday in Miami. Kahne, 27, is charged with one count of battery against Archibald Hutchison, who was working as a security guard at the speedway for a race Nov. 16 when the incident allegedly occurred. According to a Homestead police report, Kahne was attempting to access a restricted recreational vehicle parking lot on a golf cart after he finished driving his racecar when Hutchison stopped him and asked him for credentials. Kahne stated that he was a driver and didn't need any, then got out of the golf cart and tried to walk through the gate, the report stated. When Hutchison blocked the entrance and asked Kahne for credentials again, Kahne pushed Hutchison to the ground, according to the report. The report said Kahne was stopped and detained by law enforcement officers who witnessed the incident. He was arrested later that day and released on the signed condition that he appears in court. Hutchison, who was advised not to let any unauthorized people through gate 208 without exception, was treated at the speedway's medical facility for minor bruises and abrasions, according to the report. Dohan said Hutchison hasn't been able to return to work because of his injuries. Dohan said his client has suffered emotionally from the incident and is "getting killed" by NASCAR fans on Web site blogs. He also said he planned to have his client speak with the media about the lawsuit at a news conference planned for Tuesday.(local10.com)(12-17-2007)

This is a fine example of where a guy does his job like he is told to do. He gets knocked to the ground, but come on unless he broke his pelvis or something He really should be able to return to work in a couple of days. This man is using the system of Injury Laws to sue a Race Car driver, whom he probably knew who he actually was. But I can give the Guard credit, no badge, no entry, he did his job. If he had of let him thru and his supervisor found out he could have been fired for not doing his job right.

Call me crazy, but I'm siding with the guard. He was just doing his job and it would appear that Kahne was just being a prick. So what if he loses a million dollars, he makes more in a week then most people do in 2 years. If you can't show respect for someone doing their job then he needs to be taught a lesson.

Your not crazy Art my thoughts exactly. Just another up and coming hot head punk driver that if I had my way would have spent the night in jail for pushing that old man to the ground in the first place. I hope he sues him and win's big..Maybe teach that kid a lesson. I am sure his car owners sponsers love the attention also.

Amen!!!!!! He thought he was to good to follow the rules. He needs to pay. Maybe next time he will keep his hands to himself and follow the rules.:eek:

I think they should hire bigger tuffer gaurds so when a punk like this wants to push one down he can get his a&& kicked like he needs....Takin easy come money from him aint gonna teach him anything.

Khane's how old? This man was 62. If that was my dad, I'd be out looking for some payback on a race car driver.

IF you want payback,, go take care of him yourself ! I'm sure that some ambulance chaser had him cornered before he ever left the track. :rolleyes:

IF that had been my Dad, he would have run over Kahne like a freight train for what he did. ;)

If the events cited in the story are true (which I doubt), I agree that Kahne is deserving of a "time-out" until he learns to "play nice with the other kids".

IMO, the guard should win his lawsuit. I think he's entitled to win about $300 for his pain and suffering, since nothing happened to him except some bumps and bruises (if that).

In large measure, this matter should be handled through the appropriate criminal justice system. Lawsuits like this one are a prime example of what's wrong with the American civil judicial system.

Regardless of what we believe about Kahne (apparently he's a complete arsebag), I don't understand why this guy can't continue to work?? He got pushed down for crying out loud. This story reminds me a lot of the Dennis Rodman cameraman kicking incident a few years back.

You guys want to let the guy retire b/c you believe Kahne is a prima donna tool. If it's OK for this guy to "win big", stop working and retire (solely to punish Kahne), you can't ever complain about runaway plaintiff's lawyers anywhere.

In every single suit involving a celebrity, I can assure you that the plaintiff's lawyer is going to stand up before their respective juries and tell them that the jury needs to make an example out of the famous defendant, the same thing you're saying here about Kahne.

Kahne should pay for the guy's medicals and face criminal charges for simple assault. That's it. This guy's "getting killed" on NASCAR blogs, not b/c he got pushed down by Kahne but b/c he filed a BS lottery lawsuit. Think about it. . . If this guy was such a big NASCAR fan that he's a regular on the blogs, you think he wouldn't have recognized Kahne??? Moreover, if he's so emotionally fragile that physical contact and getting pushed prevents him from ever working again: (a) what in the hell was he doing being a security guard? and (b) why would he have ever "blocked" Kahne again after Kahne ignored him the first time?

Assuming again that the stories as written are true, I hope Kahne gets to spend a week or so in jail for his simple assault conviction. I hope this security guy gets absolutely ZILCH beyond a few hundred bucks.

When I said OUT looking for payback, tha's exactly what I meant. Taking care of things the old fashioned way.

I'm sure some lawyer pressured him into suing, and I hate ambulance chasers. But I'd be willing to bet if the old man had gotten up and pounded him, the lawsuit would have been reversed.

It's stupid no matter which way it goes. Kahne should get his day in court, criminal court that is, and be made to pay the doc bill but that's it. The other crap needs to go away.

Perfect example of the "Paris Hilton attitude". I don't even watch racing, but I recognize this guys name. This guy figures he is over the rules. Hope he pays. If it had been my dad or grandad I would want blood.:mad:

I agree with the lawyer (BF) on this one.:eek: Pretty much everything you said really. I would assume that Kahne offered to pay him something but that's just an assumption on my part. A person's income shouldn't be considered when a judgment is handed down. Scrapes and bruises are scrapes and bruises regardless of who did the pushing, IMO.

They said on the news this AM that Kahne was being sued for $15K. That was about the only thing they said.

That's what the security guy is claiming are his hard damages. He will also be pursuing punitive damages to make an example out of Kahne, probably in the neighborhood of an extra $50K or so.

Man, some people have all the luck!!!! :mad:

I just hope that some famous arsewipe pushes me down some day so that I can have some free money too!!! :D

Kayne should be ashamed and needs his arse kicked. But all of these civil suites are only making lawyers money and costing every one else. I have my own business personal liability insurance is out the sight.
If I was rich and famous I don't think I would leave the house. 90% of the people out there go cha-ching, how can I get him/ her to hit me or rape me.
