how does he get out of the 50 ft. easement rule. I was told it was 50 anywhere on a state park lake.

Look at the Lake Malone State Park map, looks like state property is a small tract. Lots of private resort and property all the way to water. Right?
Is there a "red" line??

Mike from where the TVA powerline crosses the lake near Sherwood point all the way to the back of that section of lake that runs to the left and back to Sherwood the farmer never sold the state the property except what the water covers at normal pool. That's around 3 or 4 miles of lakefront. That real low point everyone likes to camp on you can see from Sherwood is part of that property, that one lot is on the market now for $175K.....

Yes most of the lake has a 50 ft easement around it, just this one area don't that I know of. The property line pins are for the most part set 50 ft from the normal pool line up the shore.

That doesn't sound right, I would check on it, before I started to build anything. Your buddy probably needs to go to the meeting. I would say there would be some people that could tell him what is what. I doubt the state would over look his property or would treat him any different than the rest, but I really don't know.

Been there done that...the state knows they don't have a 50 ft easement on that section of lake and have admitted so. This goes back to way before my friend bought that section of property to when the lake was formed and the original land owner. It's all in the deed's and nice and proper. A lot of it had to do with the original construction of the dam and the amount of acres the lake was supposed to cover. The dam didn't come out as planned and was near failing and had to be reconfigured. Bet you didn't know if it was built to the specifications in the first go round you couldn't travel under the bridge by Shady Cliff in a boat.

I understand the construction issue is the building of stairs and landings on the part of the lake that is under the 50 ft rule. If the state wanted to they could make everyone that has built anything on that 50 ft remove it. I bet it will not go that way and those in place now will be left alone but futher construction may not be allowed. If i remember correct from way back the state tried to stop anyone from even clearing brush within that 50 ft but as anyone can see that has not been enforced.

it's about time they started cracking down on all that tree cutting. As we have discussed before, there is a 50 ft barrier between the water and the private property.
